Westmorland and Furness Council have been challenged over the council’s failure to obtain planning permission for the creation of a new vehicle gateway into CastlePark onto the busy Ullswater road.
In addition to the planning permission Evolve Penrith have also challenged the fact that the works are within the curtilage of a listed structure and as such require listed building consent before the commencement of works. Failure to obtain listed building consent before carrying out works without the required permission is a criminal offence.
Westmorland and Furness Council planning officers have confirmed that “after further investigation and discussions, We have determined that the formation of a new access does indeed require planning permission in its own right.”
Meanwhile, planning enforcement officers are still assessing whether the works to the listed War Memorial gateway are subject to Listed Building Consent.
Westmorland and Furness Council will now be required to submit a retrospective Planning Application for the formation of the gateway access it has built into CastlePark without planning permission.
